Uniform Commercial Code

The Uniform Commercial Code (UCC) for the State of Missouri was substantially revised with the passage of Revised Article 9. The Code applies to all transactions which are intended to create a security interest in personal property or fixtures located in Missouri. Banks, mortgage companies and leasing companies file the largest volume of these liens.

Where to File

Revised Article 9 (Uniform Commercial Code) went into effect in Missouri on July 1, 2001. There were many changes in this UCC law. This law centralized UCC filings with the Secretary of State. Real estate filings continue to be filed in the County Recording Office in Independence.

There are no longer dual filings and recording of fixture or as-extracted collateral or timber filings. The Recorder of Deeds Department will accept only financing statements relating to real estate.

Because UCC instruments were filed in Jackson County's office prior to July 1, 2001, these records will be maintained at County offices and remain effective until they lapse or are terminated.

UCC Filings

  • Under the provisions of Revised Article 9, the Recorder of Deeds Department cannot accept and must refuse any UCC filing except Fixture Filings, Terminations and Search/Information Requests. There is no charge for terminations of pre-July 2001 filings.
  • New Revised Article 9 (RA9) forms or the old FA9 forms may be submitted for terminations relating to any UCC-1 that was filed in the County office prior to July 1, 2001. No signature is required on either form since July 1, 2001.

UCC Filings In The Real Estate Records

  • If the new approved standard form is used when filing or terminating any fixture filing or one that covers as-extracted collateral or timber, no signature or notarization is required to be recorded in the real estate records. If any form is prepared and presented other than the state-approved form all recording requirements of law will apply.
  • Legal descriptions must be placed on the Addendum form. Even if the property is listed elsewhere on the UCC-1, the additional Addendum page is required and there will be a minimum of two pages required for a valid filing.
  • Statutory recording fees will apply to all real estate related filings.
