  The Contractor Utilization Plan (CUP) is a list of MBEs, WBEs and VBEs that a prime contractor commits will be utilized, including its own participation as an MBE or WBE, if applicable. The CUP will list scopes of the work and the percentages of the contract value to be performed by each certified firm. CUPs are included in initial bid documents. Jackson County Code Sec. 626

  A CUP Modification Form is used to substitute and/or add a certified firm not previously listed on the Contractor Utilization Plan (CUP). Subcontractors may not be added or substituted without prior authorization of the Compliance Review Office and the using department. Failure to submit a CUP Modification Form prior to any changes in certified subcontractors on a project may cause termination of the executed contract for breach, the withholding of payment, and/or subject the Contractor to contract penalties or other sanctions.

  Good Faith Efforts are actions undertaken by a contractor to achieve MBE or WBE contract goals which, by their scope, intensity, and appropriateness to the objective, can reasonably be expected to fulfill the contract goals. When subcontractor utilization goals cannot be met, whether during the bid solicitation or throughout the duration of an awarded contract, a Good Faith Effort Form must be submitted to the Compliance Review Office. This form will provide an outline in which the contractor shall fully document its efforts to meet the assigned contract goals.

Certified Firm. A Certified Firm is one that has been accepted by the County as a certified MBE or WBE.

Minority Business Enterprise (MBE). A business, including a sole proprietorship, partnership, corporation, limited liability company, Joint Venture, or any other business or professional entity that is at least 51% owned by one or more Minority Individuals, performs a Commercially Useful Function and is a Certified Firm.

Woman-Owned Business Enterprise (WBE). A business, including a sole proprietorship, partnership, corporation, limited liability company, Joint Venture, or any other business or professional entity that is at least 51% owned by one or more Women, performs a Commercially Useful Function and is a Certified Firm.

The County accepts certifications from organizations whose certification standards, policies, and procedures meet the requirements of strict constitutional scrutiny including but not limited to:

Jackson County encourages and supports VBE utilization. Participation in the VBE program, outlined in Chapter 10 of the Jackson County Code, is voluntary.

If goals cannot be met on a Contractor’s Utilization Plan in a bid solicitation or at any time throughout the duration of an awarded contract, a Good Faith Effort Form(PDF, 227KB)must be submitted to the Compliance Review Office. The Compliance Review Office is available to assist any contractor who needs help in identifying subcontractors, or with any other aspect of the compliance process.
