Responds to Schools Districts’ Suit

August 12, 2009 (KANSAS CITY, MO) – Today attorneys for the Jackson County Assessment Department filed a Motion to Dismiss in Jackson County 16th Circuit Court regarding a suit brought by a group of school districts administrators last week.  The issue is scheduled to be heard Thursday afternoon August 13 at 1:30 pm in Division 2 by Judge Michael Manners on the 2nd Floor of the Independence Courthouse Annex located at 308 West Kansas in Independence, Missouri.

In the response (attached) to the lawsuit filed by the school districts, the Assessment Department’s legal council points out that to do as the school districts ask would be to disregard the fundamental rights under the Missouri Constitution and the U.S. Constitution and to force an illegal tax increase upon the taxpayers of Jackson County.

Further, the motion to dismiss makes clear that the school districts are asking the court to undertake an unprecedented violation of the due process rights of every taxpayer of Jackson County.
